DAL-005 Form: Official Application and Supporting Documents

DAL-005 is the Judicial Council of California application for a stay of proceedings, an early evaluation conference and a joint inspection in a construction-related disability-access case. It asks the court for those orders; downloading or submitting the form does not itself grant them.

The California Courts DAL-005 page identifies the application and its July 1, 2016 effective date. The download below is the unchanged official two-page PDF, with a preview of each page. It is marked for mandatory use.

Use the court’s Adobe Reader guidance for completing court PDFs. The original form uses XFA technology; a browser may display the page without supporting all of its form functions. The revision date identifies this document, but it does not establish the procedure or deadlines for a future filing.

Follow the request and declarations on both pages

The application begins with case and party information, the requested relief and declarations concerning the case. It continues onto a second page with further declarations, requested orders and signature sections. Read both pages before treating the application as complete.

The official form includes four category headings:

  • CASp-Inspected Site
  • New Construction
  • Small Business
  • Case Filed by High-Frequency Litigant

Each heading introduces fuller conditions and declarations. Read that wording in the form rather than deciding which box applies from the heading alone. Calling a business “small,” for example, does not establish that every condition of the corresponding declaration is met.

For any declaration you are considering, connect the checkbox to its complete wording and the supporting material it specifies. The form also contains a separate defendant declaration and signature section. A signature in one place does not establish that all applicable parts elsewhere have been addressed.

Keep the application and supporting records distinct

DAL-005 refers to supporting records that are filed separately with DAL-006, the Confidential Cover Sheet and Declaration re Documents for Stay and Early Evaluation Conference. Follow the official directions for the records that apply to the declaration being made. The application download is not a complete filing packet, and a cover-sheet title alone does not explain every handling requirement.

The court’s Disability Access Litigation forms list also identifies DAL-002, Answer—Disability Access. That is a separate form with a different role. DAL-005 should not be treated as a general answer to a complaint.

Use those distinctions to locate the relevant official documents. Keep case records in the appropriate filing process; do not put private supporting material into a shared template or assume every applicant needs the same attachments.

Check the current court procedure before filing

Consult the current official form instructions and California Rule of Court 3.680, which addresses service of the application and notice and the filing of proof of service. Those procedural steps are separate from identifying and downloading DAL-005.

For which declarations apply, what to submit and when to act in a particular case, consult qualified counsel or ask the court’s self-help service what assistance it provides. Verify the current requirements before relying on a saved form or treating the application as the only document your case needs.
